We’re an independent editorial directory. We don’t host/sell themes; any logos or theme snapshots are used for identification (nominative fair use). DMCA claims must be 100% accurate; false or bad-faith complaints may trigger action. We publish under editorial independence and free speech.

ThemeMyBlog.com (“Theme My Blog,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our users and partners to do the same. This policy explains how we handle notices and counter-notices under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”).

What Theme My Blog is: a directory and editorial website that indexes, reviews, and links to third-party Ghost themes and related resources. We do not host or distribute third-party theme files; we provide informational listings and outbound links. Screenshots or thumbnails appearing on our site are for identification, review, and informational purposes ONLY.


1) Designated DMCA Agent

In accordance with the DMCA, we have designated the following agent to receive notices of alleged copyright infringement on our site:

To maintain safe-harbor protections, we keep our agent information current. If any contact method fails (e.g., a bounced email), please resend using an alternative method.


2) What This Policy Covers

  • Locations: Thememyblog.com and any subdomains we operate.
  • Content Types: Text, images, thumbnails, screenshots, graphics, and other materials hosted by us.
  • Not Covered: Content hosted on third-party websites we link to. If allegedly infringing material appears off our site (e.g., on a developer’s store, demo site, or hosting provider), please contact that site’s operator or host.

3) Submitting a Proper DMCA Takedown Notice

If you believe content on Theme My Blog infringes your copyright, you may send a written notice to our Designated DMCA Agent that includes all of the following (see 17 U.S.C. § 512(c)(3)):

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work claimed to have been infringed (a representative list is acceptable for multiple works).
  3. Identification of the material on our site that you claim is infringing, including its specific URL(s) to help us locate it.
  4. Your contact information—name, mailing address, telephone number, and email address.
  5. A statement of good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Format Tips:

  • Please send notices in English and include clear, direct links (full URLs) to each page at issue.
  • If your claim concerns a screenshot/thumbnail, explain briefly why the specific use is not fair use or otherwise authorized.
  • If your claim concerns code or full-resolution images, identify the original work(s) and where they appeared first.

We will expeditiously review properly formatted notices and remove or disable access to the material when appropriate. We may contact you for additional information if the notice is incomplete or unclear.


4) What We Do After Receiving a Notice

  • Initial review: We verify that the notice is complete under §512(c)(3).
  • Temporary action: We may remove or disable access to the identified material pending our assessment.
  • Notify the user/uploader (if applicable): If the material was provided by a user (e.g., in comments or a submission), we will notify them and may share the notice in full.
  • Recordkeeping: We maintain a log of DMCA notices and actions taken.

If we determine the use is likely protected (e.g., fair use thumbnails for identification/review), we may decline removal. However, rights-holders remain free to pursue other remedies.


5) Counter-Notification (Restoration Request)

If your content was removed (or access disabled) due to a DMCA notice and you believe this was a mistake or misidentification, you may submit a counter-notification to our Designated Agent. Your counter-notification must include (see 17 U.S.C. § 512(g)(3)):

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location (URL) where the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of:
    • the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, the Federal District Court in which Theme My Blog may be found; and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent.

Upon receipt of a valid counter-notification, we may forward it to the original complainant. If we do not receive notice that the complainant has filed an action seeking a court order to restrain the allegedly infringing activity within 10–14 business days, we may restore the material at our discretion.


6) Repeat Infringer Policy

Consistent with §512(i), it is our policy, in appropriate circumstances and at our sole discretion, to terminate accounts or submission privileges of users who are repeat infringers. We also reserve the right to remove content and block users proactively where patterns of infringement are apparent.


7) Accommodation of Standard Technical Measures

We accommodate and do not interfere with standard technical measures recognized by the industry to identify or protect copyrighted works, as required by §512(i).


8) Good-Faith, Fair Use, and Misrepresentation

  • Fair Use / Identification: Because Theme My Blog is a directory and reviews site, we may display thumbnails or screenshots and use names/marks nominatively to identify products for commentary, comparison, or indexing. Such uses are lawful under U.S. copyright and trademark doctrines (including fair use and nominative fair use).
  • Please assess fair use before sending a notice. If your work is shown only as a small, contextual preview to identify a theme or illustrate a review, explain in your notice why the specific use is infringing.
  • DMCA §512(f): Anyone who knowingly misrepresents that material or activity is infringing may be liable for damages (including costs and attorneys’ fees) incurred by us, our users, or the alleged infringer.

This policy addresses copyright only. If you have a concern involving trademarks (e.g., brand misuse), privacy, or other legal rights, please contact us at rights[at]thememyblog[dot]com with:

  • Your name and contact information,
  • The exact URL(s) at issue,
  • A clear description of the concern and your rights.

We will review and respond under our separate site policies.


10) Preservation & Disclosure

We may preserve notices, counter-notices, and related correspondence and may disclose them to the parties involved, third-party service providers, the public (e.g., a transparency report), or as required by law (e.g., subpoenas under §512(h)).


11) No Waiver; Reservation of Rights

We reserve all rights to remove content, disable access, or take other action at our discretion and without notice, including in situations that are not clearly addressed by the DMCA. Nothing in this policy waives any defenses or objections available to us or our users.


12) Practical Guidance for Rights-Holders

To expedite our review:

  • Provide working links and side-by-side comparisons (if relevant).
  • If your claim is about code, identify the specific snippets and where they appear on our pages.
  • If your claim is about images, specify whether they are original promotional images, demo captures, or our own review thumbnails, and why the use is not authorized.

13) Editorial Independence; Non-Removal (Non-DMCA) Requests from Theme Developers

Purpose. ThemeMyBlog.com (“Theme My Blog”) is an editorial directory that indexes, reviews, and links to third-party Ghost themes. We exercise independent editorial judgment regarding what to list and how to rank, rate, describe, and categorize third-party themes. Our listings, ratings, and commentary are our own opinions and reporting based on publicly available information and our testing.

No preauthorization required. Under U.S. law, we do not require a theme developer’s permission to reference or identify their products in an editorial directory. Consistent with nominative fair use, we may reference brand names and theme names to identify the products at issue, and, where reasonably necessary for identification, we may display limited brand indicia (including logos) and screenshots for contextual, informational, and review purposes. See also Section 8 (Good-Faith, Fair Use, and Misrepresentation).

Non-DMCA delisting requests are denied. We do not entertain or honor requests from theme developers to remove, delist, suppress, or alter the existence of a listing or the substance of our editorial ratings/reviews absent a valid legal basis (e.g., a properly-formed DMCA notice regarding material we host, a final court order, or a demonstrable, non-copyright legal violation such as defamation supported by specific facts). Unsolicited requests to delist, to downgrade visibility, or to modify ratings without such basis are treated as impermissible attempts to influence or manipulate editorial rankings and will be declined.

What we may display. For identification and review purposes only, Theme My Blog may display:

  • Brand names and theme names in plain text;
  • Stylized brand logos strictly as necessary to identify the source of the goods/services, without implying sponsorship or endorsement; and
  • Theme screenshots or thumbnails captured by us or sourced from publicly available materials, shown at an identification-appropriate size and resolution, solely to illustrate the theme’s appearance and features.
    We do not distribute, sell, license, or host third-party theme files or proprietary assets, and we do not claim ownership over any third-party intellectual property.

No endorsement; clear attribution. Our use of names, logos, and screenshots is informational. We do not represent, and users should not infer, that any developer sponsors, endorses, or is affiliated with Theme My Blog unless expressly stated. We include clear non-affiliation disclaimers and brand attributions where appropriate.

Process for developers with specific concerns (non-copyright). Developers who believe a listing contains a provably false factual statement (as opposed to opinion or rating) or a misuse of their brand (e.g., a misleading logo placement that could plausibly imply endorsement) may contact us at rights[at]thememyblog[dot]com with: (i) the exact URL(s); (ii) a concise explanation of the issue; and (iii) supporting documentation. We will review in good faith and, at our sole editorial discretion, may clarify, correct, or adjust presentation without altering our independent opinions or ratings.

Abusive legal threats and misuse of takedown processes. We reserve all rights and remedies with respect to bad-faith or knowingly inaccurate infringement assertions, demand letters intended to coerce editorial changes, or efforts to misuse the DMCA or similar mechanisms to suppress lawful commentary (see 17 U.S.C. § 512(f)). Where appropriate, we may document and publish a transparency log of such requests in public (on our/3rd-party website and/or public forums), including the requester’s name, the claims asserted, and our response.

No conflict with DMCA procedures. Nothing in this Section limits or modifies our obligations under the DMCA. Bona fide copyright claims concerning content hosted on our servers must follow the notice requirements in Sections 3–5. Non-copyright issues (trademarks, privacy) should follow Section 9. Requests that do not satisfy those procedures will be declined.

Reservation of rights. Theme My Blog retains sole discretion over its editorial judgments, including whether to list, delist, rank, or revise content, and over the layout, formatting, and presentation of any third-party indicia displayed for identification.

Editorial non-interference. We will not alter or remove our ratings, reviews, or rankings at a developer’s request in exchange for consideration or to avoid negative coverage. Attempts to condition access, impose prior restraints, or otherwise interfere with our editorial process may result in refusal to list the developer’s products in the future, and we reserve all rights to pursue any and all legal remedies available for threats, coercion, or knowingly false infringement assertions intended to compel editorial changes, including (where applicable) injunctive relief, damages, attorneys’ fees and costs, sanctions, and claims for tortious interference and abuse of process, as well as remedies under 17 U.S.C. § 512(f) and applicable anti-SLAPP statutes.
